Professional Experience

Mr. Weinstein has assisted three volunteers in obtaining Covenants-Not-To-Sue (Mosler Safe, Hamilton, Ohio; Jefferson Smurfit Paper Board Plant, Lockland, Ohio; and Carthage Mills, Cincinnati, Ohio) through the Ohio Voluntary Action Program (VAP).  He has also issued four additional No Further Action Letters, which are currently under review, and aided numerous other clients with VAP-related issues.  As a Certified Professional and an expert in the VAP, Mr. Weinstein is currently the manager or team member on numerous other VAP sites.  Mr. Weinstein has been directly involved with Ohio’s VAP and Clean Ohio Fund since their inception.  Through his efforts and that of other SRW team members, he has successfully aided clients in obtaining over $12,500,000 in Brownfield-related grants.

Select Project Experience

Prepared a No Further Action Letter for a VAP cleanup conducted at the former Jefferson Smurfit Box Plant in Lockland, Ohio.  Site activities included two-year assessment and removal action.  Mr. Weinstein managed and authored reports for the Phase I/II Property Assessments, performed a quantitative risk assessment, interfaced with the Ohio Environmental Protection Agency (OEPA), and managed the razing of the facility.  The $2.5M site remediation resulted in a Covenant-Not-To-Sue (CNS) (issued May 15, 1998); the owner received a $1M grant from the State of Ohio, a $150,000+ tax credit, and a ten-year tax abatement.  In 2004, Mr. Weinstein updated and revised the NFA, which will result in a new CNS and new ten-year tax abatement.

Obtained the first OEPA Brownfields WPCLF low-interest loan awarded in the State of Ohio for a client.  The loan, approximately $100,000, was used to conduct the Phase I/II Property Assessments under the VAP, the design of engineering and institutional controls, and issue the No Further Action Letter.

Mr. Weinstein was recently engaged by a Fortune 500 company to assist in three voluntary actions.  The volunteer acquired three plants that manufacture specialty components for the aerospace industry and the military.  The volunteer, through five prior consulting firms, had been unable to satisfy Ohio’s VAP requirements.  Mr. Weinstein has successfully completed the required VAP program tasks and has issued the No Further Action Letters for the properties.  Covenants-Not-To-Sue were issued on June 21 and August 4, 2004.

Conducted an investigation, performed remediation, and prepared a No Further Action Letter for a 120-year-old Mosler Safe manufacturing site participating in the Ohio VAP.  This work resulted in a Covenant-Not-To-Sue.  In 2002, Mr. Weinstein and SRW Environmental Services, Inc. assisted the City of Hamilton in obtaining a grant from the Clean Ohio Fund.  Using the City’s Brownfields Cleanup Revolving Loan Fund (BCRLF) Grant and the COF Grant, Mr. Weinstein and SRW are completing a MOA Track Voluntary Action and remediating the site to eliminate the need for the existing engineering controls to enable the site owner develop an unrestricted commercial development.

Mr. Weinstein, under contract to Al. Neyer, Inc., a 100-year old development company, assisted General Motors in negotiating an operation and maintenance agreement with OEPA and obtaining a Covenant-Not-To-Sue for the former GM-Globe Lot in Norwood Ohio. GM and their certified professional made two separate NFA submissions to the agency and had been working through deficiencies for over two years.  In 2002, Mr. Weinstein and SRW were asked to intervene and bring closure to the outstanding issues.  Within three months of our engagement, the Director of OEPA issued the CNS.

Mr. Weinstein is currently assisting a client with a Voluntary Action and cost recovery suit under the VAP.  The site, located in a small industrial town, is a prime piece of undeveloped real estate.  During an investigation of an adjacent gasoline station, the property owners were advised that their property was contaminating groundwater.  Mr. Weinstein and SRW were asked to assess the situation and advise the owner’s legal counsel of their findings.  The initial assessment revealed that approximately one acre of the site is where an adjacent chemical company had disposed of various chemical products.  Phase I and Phase II Property Assessments under the VAP were conducted, and a cost recovery action through the VAP is underway.

Conducted an investigation, performed remediation, and prepared a No Further Action Letter for a 100-year-old linoleum manufacturing site (Carthage Mills) participating in the Ohio VAP.  Site activities included asbestos abatement, Phase I Property Assessment, Phase II Property Assessment, removal and disposal of solid and hazardous waste, a risk assessment, and building demolition.  The site was remediated to unrestricted residential standards. A Covenant-Not-To-Sue was issued on March 14, 2001.  SRW was the prime contractor to the City of Cincinnati and completed the project for a guaranteed fixed price, which included a cost cap and PLL insurance policy.

Mr. Weinstein, in cooperation with the Village of Lockland, prepared and submitted an application for a U. S. EPA Brownfields Assessment Demonstration Pilot Grant.  The Grant was awarded in March 1999.

Selected by the Ohio Environmental Protection Agency and assisted in the rules writing subcommittee for Certified Professionals and Certified Laboratories under the Ohio VAP, and consulted and reviewed other subcommittees’ rule writing efforts.
